Litigation Attorney The candidate will handle mortgage-related litigation files as lead counsel in State, Federal and Bankruptcy Courts. Provide legal advice to the Firm s mortgage servicing clients. Research and analyze legal sources such as statutes, recorded judicial decisions, legal articles, treaties, constitutions, and legal codes. Prepare legal briefs, pleadings, appeals, contracts, and any other necessary legal documentation during the course of litigation in State Circuit Court, Probate Court, (State) Appellate Courts, Federal District Court, Federal Bankruptcy Court, and the Eighth or Fifth Circuit Court of Appeals. Handle civil litigation cases from referral to resolution, which may necessitate the use of written and oral advocacy, motion practice, discovery, trial preparation, trial, and appellate court briefing and argument. Participation in mediation, willingness and ability to understand complex loan documentation and loss mitigation processes, Should have Bachelor s Degree or higher. Doctor of Jurisprudence is needed. Must be licensed to practice law in the State and Federal Courts in (State), including Bankruptcy Court and the Eighth or Fifth Circuit Court of Appeals. Should have 3+ years experience in finance or representation of financial institutions in real estate related matters.
