Bankruptcy Attorney The candidate will handle Chapter 7, Ch 13 and Chapter 11 creditor work. Candidates should possess bankruptcy experience either with debtors or creditors and be able to handle a bankruptcy case from intake through discharge. Must be licensed in California. Experience in general civil litigation are preferred. Client relations; consult with and advise clients. Work with contractor attorneys. Manage contract attorney to handle tasks with bankruptcy. Specialized in creditor's rights, collecting and commercial debt. Obtaining judgments by court trial, default, and stipulation; Court Trials, Mediation, Arbitration, and general courtroom experience; Attend all court hearings. Prepare filings and electronically file legal documents with its respective courts. Create and manage document production. Prepare for depositions, including managing exhibits and exhibit logs and manage deposition transcripts and Exhibits. Drafting pleadings, demand letters, complaints, discovery, discovery motions, discovery responses, demurrers, client memorandum summary judgment motions, motions for judgment; including motions to compel, protective and other research assignments. Drafting oppositions to demurrers, motions to quash service. Handling Post-Judgment matters: claims of exemptions, wage garnishments, bank levies, judgment debtor exams, assignment of rents/commissions and opposing motions to set aside; Knowledge of Creditor's rights in Bankruptcy: Evaluating Chapter 7 and 13 petitions for valuation issues and strip down issues, filing relief from stay motions, filing objections to plan confirmations, Participate in mediation and settlement conferences with the parties and the judge; and create settlement brochures, agreements, etc. Ability to manage multiple cases at once. Excellent time management, organizational and communication skills. Applicants must be an attorney in good standing to practice law in California State. Strong interpersonal and collaborative skills.
