Associate Attorney Duties: Responsible for overseeing, maintaining and aggressively pursuing positive results with a substantial caseload of collection related matters. Responsible for meeting exceptionally high service levels while also providing day to day legal support related primarily to debt collection practices and possibly bankruptcy matters. Maintains an active and substantial caseload. Handle files beginning from prior to the initiation of suit, through judgment, and then in the post-judgment execution phase. Interprets state and federal statutes, rulings and regulations impacting the firm s practice and advises operations. Keeps the firm regularly informed as to changes in statutes, case law and regulations, and ensure updates are provided as needed to the contested litigation practice including those related to developments in CFPB supervision and federal laws such as the FDCPA, TCPA, FCRA, and SCRA. Assists with FDCPA defense litigation and compliance issues as needed. Reviewing documents for relevancy, accuracy, redactions, identification of documents for further review, and to ensure they meet statutory and regulatory requirements. Communicates factual information and litigation strategy to clients, and communicates regularly with court officials, staff and attorneys in an ethical, knowledgeable and precise manner. Responds swiftly to client inquiries, and does so in a courteous and professional manner. Receives incoming telephone, correspondence and email inquiries from clients, defense counsel and other Attorneys associated with pending cases, and responds to all as needed. Understands and adheres to all client guidelines, the NC Rules of Professional Conduct and NC Rules of Civil Procedure. Understands and possesses a working knowledge of the Firm s JST software program, actively coordinates, tracks and aggressively pursues activity in each case throughout the litigation process. Performs other related duties as assigned. Qualifications: JD Degree from accredited law school. Membership in the North Carolina State Bar as an attorney qualified and licensed to practice law in this state. 1-3 years of litigation experience with a small to midsized law firm. Document review experience a plus. Knowledge of federal, state and local laws. Ability to analyze statutes, case law, formulate litigation strategy and to provide appropriate recommendations. Advanced knowledge and thorough understanding of state and federal collection law and regulatory requirements is preferred. Represents the firm and its clients in all legal proceedings, attends court hearings, depositions, mediations and trials when required. Thorough experience in writing, reviewing, and editing pleadings, motions, briefs, memoranda and reports in all phases of litigation, as well as with correspondence, articles, and other documents. Maintains an impeccable professional appearance and presents a positive attitude and image at all times, both within the firm and to the public. Proficient in Microsoft Word, Outlook, Excel. Excellent interpersonal skills, oral and written communication skills. Strong analytical and research skills related to the retrieval and organization of high volumes of information. Excels in time management, with a proven ability to maintain an exceptional level of productivity in a high pressure and challenging environment. Interacts exceptionally well with people throughout all organizational levels of the firm. Thinks globally by way of strategic planning and overall risk management. Effectively responds to all manner of inquiries and/or tasks presented by the Firm Attorneys, Managers and clients, as well as effectively communicates with defending Attorneys, and with the general public subject to applicable statutes and regulations.
