Healthcare Associate Attorney Duties: Provide legal support to clients including medical professionals, small- to mid-sized healthcare practices, and mHealth companies on licensure, scope of practice, regulatory compliance, and day-to-day business issues. Attend professional and networking events at the direction of the firms managing partner to support the firms name recognition and broaden its professional networks. Draft blog posts and online articles on topics of interest to the firms clients. Assist the firms senior attorneys with other projects as assigned, including occasional clerical or menial tasks as required of all members of a small firm. Actively engage in continuing education about healthcare topics, including reading healthcare legal news, staying apprised of current events, and monitoring courts for health-related decisions impacting the firms clients. Review employment contracts and negotiate contract terms on behalf of individual (and often early career) medical professionals. Draft employment, independent contractor, collaborative, and other contracts which comply with all applicable healthcare laws, fee-splitting provisions, and professional scopes of practice. Draft pleadings, discovery requests and responses, research memoranda, and correspondence to clients in litigation; attend court status calls and hearings; engage in negotiations with opposing counsel. Create HIPAA policies and procedures manuals, and advise clients on topics relating to HIPAA compliance. Advise clients as to the Anti-Kickback Statute, False Claims Act, Stark Law, and state equivalents. Open new practices and businesses, including preparing corporate formation and governance documents. Once trained and familiar with the firms work: conduct potential client complimentary consultations as required, prepare retainer agreements for client review and signature, prepare written quotes for services requested by potential clients. The candidate must be barred in Illinois and should have 1-3 years of healthcare law experience. Must understand and appreciate the role of healthcare in societal and community health, including a recognition of healthcare as a human right, a thriving employer of millions, and a burgeoning area of law. Their interest in law is genuine, curious, and enthusiastic. Must understand the framework of the CFRs and the regulatory scheme that underscores much of the work of a regulatory healthcare attorney. Crucially, they must have an exceptional attention to detail. May be required to attend court appearances in downtown Chicago. Will be expected to meet a reasonable billable hours requirement. Must possess knowledge of health law matters including federal and state laws, hospital and health care regulations, and knowledge of legal aspects of contract agreement negotiations, practices, and structures.
