Plaintiff's Personal Injury Paralegal / Legal Assistant The candidate will focus of this position will be mass torts and single event injury cases. Litigation experience, medical legal experience and experience in pre-suit preparation for medical legal matters (i.e.: requesting medical records, billing, insurance information as well as drafting discovery responses) is required. Will work directly with the Attorneys and will be primarily responsible for the pre-suit and litigation aspects of cases. Work closely with the Attorneys and other support personnel to make sure that all aspects of each case are being properly handled. Answer all incoming calls on assigned cases. Will review all incoming mail and correspondence, and immediately route it as necessary. Send all outgoing correspondence. Draft outgoing letters and prepare outgoing mail. Communicate with client regarding progress of case. Draft and send fee agreements, client questionnaires and initial case intake documents. Obtain signed medical authorizations from client. Track and monitor Under Consideration (UC) cases. Transcribe dictation. Obtain necessary records, photos, evidence. Obtain all insurance information. Communicate with insurance adjusters. Communicate regularly with the supervising attorney regarding case status and progress. Prepare settlement statement and close-out paperwork. Schedule hearings, depositions and other matters. Calendar deadlines, follow up reminders, and all events. Ensure that all case-related information is properly saved to Trial Works (TW) immediately. Prepare and send out decline letters, and other correspondence to clients. Prepare notices of depositions, hearings and other matters. Prepare hearings and deposition folders. File all hard copies of documents and maintain and organize hard file for each case. All other matters necessary to properly handle case. Demonstrate proficiency in use of Case Management System (Trial Works) as it corresponds to job responsibilities. Perform all duties in conjunction with a paperless work environment. Prepare demand packages. Review and summarize depositions, as directed. Review and summarize medical records. Review and summarize medical bills & liens. Prepare witness and exhibit lists. Prepare discovery responses and draft discovery requests. Act as primary liaison with our experts. Prepare materials and exhibits for mediation and trial. Work with vendors to prepare and obtain trial and mediation exhibits. Ensure compliance with all trial order deadlines and requirements. Associate Attorney, Personal Injury The candidate will advise and assist clients with documentation regarding no-fault issues, property damage and personal injury. Will aintain contact with clients by phone, email and face-to-face meetings throughout the duration of the case. Set up cases with liability, no-fault and uninsured/supplemental underinsured insurance carriers and maintain contact with the respective adjusters regularly while the cases are ongoing. Research legal issues involving motor vehicle, premises liability and other personal injury matters. Facilitate all investigation necessary to fully prosecute personal injury claims. Document the ongoing status of each case by use of a paperless case management system and establish an individual timeline for each case based on the medical status of the client and other relevant factors. Regularly review case statuses and identify issues that may inhibit timely case resolutions. Negotiate with the insurance carrier(s) in an effort to resolve each case by way of settlement. This involves reviewing medical records and the full investigation of the case in order to assess overall case value and insurance coverage, including individual research / analysis, as well as committee meetings to complete case evaluation. Prepare detailed demand packages for the insurance carrier(s) and then endeavor to reach a favorable settlement in each case. Evaluate and negotiate liens involving Medicare, Medicaid, other health insurance carriers, New York State Disability, Worker s Compensation, Additional Personal Injury Protection and other entities. Advise and assist case managers in settlement of personal injury claims. Prepare Notices of Claim in cases with potential municipal involvement, Notices of Intentions to File Claims in cases with potential state involvement, Federal Tort Claims Act Form 95s in cases with potential federal involvement and infant compromise petitions in cases involving infant settlements. Appear in Municipal Law section 50-H Hearings, No-Fault Examinations under Oath, Infant Compromise Hearings in New York State Supreme Court, Mediations and Arbitrations on behalf of clients. Other duties as assigned. Strong knowledge of PC applications, Windows, Microsoft Office (Outlook, Word, Excel) is essential. Strong oral advocacy, writing and analytical skill is essential.
