Associate Litigation Attorney, Chinese Practice Duties: Represent national and international insurance companies and manufacturers in product liability defense litigation. Represent, communicate with corporate insurance clients in China on high-risk litigation matters. Research, analyze, and summarize U.S. and Chinese law, precedents, statutes, regulations, and government guidelines using legal databases, Nexus and Westlaw and Chinese legal databases. Draft and file court documents, pleadings, discovery, subpoenas, motions and appeals. Appear in court and arbitration proceedings for motions, trials, conferences, and settlement negotiations. Interview clients and investigate facts in complex litigation involving insurance, commercial, corporate, intellectual property, and product liability. Review, summarize, and analyze evidence and case documents. Draft and review settlement agreements in court and arbitration. Draft factual and legal memoranda summarizing U.S. and Chinese Law, and conflicts of U.S. and China laws, jurisdictional issues such as international service of process, forum non conveniens, comity, public policy, priority and reciprocity, applying China law in U.S. Courts and arbitration. Requirements: U.S. Master of Laws degree (LL.M) or a U.S. JD Degree, and a Law degree from mainland China, licensed to practice law in New York and qualified to practice in mainland China, and 1 year's insurance litigation experience researching, analyzing, and summarizing U.S. and Chinese Law, conflicts of U.S. & China laws, drafting factual and legal memoranda on jurisdictional issues such as international service of process, forum non conveniens, comity, public policy, priority and reciprocity, applying China law in U.S. Courts and arbitration proceedings. Mandarin fluency.
