Elder Law Paralegal The candidate will be part of the Elder Law team, supporting attorneys in filing Article 81 Guardianships, preparing Advance Directives, preparing Estate documents and filing with the Surrogate's Court, and assisting with applications for Medicaid. Conduct must, at all times, be in accordance with HIPAA regulations and guidelines. Draft Orders to Show Cause, Verified Petition, Social Worker's Affidavit, and Notice of Proceedings to commence Guardianship proceeding. Arrange for signatures on Verified Petition/Social Worker's Affidavit for 81 proceedings. Draft Request for Judicial Intervention and Index Number forms./ E-file all Court related document. Coordinate Personal Service on AIPs with Process Servers and the Social Workers. Service of documents on all Court appointees. Service of documents on interested parties via certified mail. Review e-mail correspondence and confirm receipt with sender. Create/maintain spreadsheets related to cases and calendar key dates and deadlines; make weekly follow up calls. Draft Testimony for Hearing. Arrange for transportation of patients to Guardianship Hearings. Draft Notice of Settlement, Notice of Entry, Orders and Judgments, Commissions, as well as Consent Oath and Designation. Draft various Guardianship-related legal documents and serve on all interested parties. Draft Estate Planning documents such as Health Care Proxies, Powers of Attorney, Statutory Gifts Riders, Living Wills, Wills, and Trusts. Draft Petitions for Administration/Probate and all supporting documentation, file with the Surrogate's Court. Draft letters and correspondence with the Court and other parties. Contact Courts and law firms regarding various matters and documents. Review time entries from prior day to ensure all time was accounted for. Follow up with Courts regarding status of Orders within reasonable time or at the direction of the assigned attorney. Review and update to Court Appointees payment report. Review Open Submitted Report for matters with expired follow up date and summary e-mail to TMI and CLT. Research legal topics and assist attorneys with materials needed for presentations. Maintain electronic law library. The candidate should have 4 Year College Degree or Work Equivalency. Must have experience in a law firm, specifically with aforementioned documents. Should have strong organization and time-management skills. Must possess a strong work ethic and be able to work independently. Adherence to HIPAA guidelines is required. Excellent written and verbal communication skills are required. should be proficient in Microsoft (Excel, Word, and Outlook) applications.
