Associate Attorney The candidate will be responsible for the following: Analysis and documentation of bioengineering, biomedical technology, and medical devices in preparation of a patent application. Prepare applications for patents and present applications to U.S. Patent and Trademark Office and World Intellectual Property Organization under the international Patent Cooperation Treaty. Liaison with patent attorneys in foreign jurisdictions, such as Europe, China, Japan, Korean, Australia, etc. to present applications to patent offices in foreign jurisdictions. Prosecute or defend clients in patent infringement and/or trade secret misappropriation litigation in U.S. federal courts and related U.S. Patent and Trademark Office adversarial proceedings, such as Inter Partes Review proceedings. Analysis of bioengineering, biomedical technology, and medical devices including patents and other technical documentation in support of patent litigation and/or trade secret misappropriation in U.S. federal courts and related U.S. Patent and Trademark Office adversarial proceedings, such as Inter Partes Review proceedings. Comprehension and analysis of an inventor s bioengineering, biomedical technology, and medical devices to provide an evaluation of the utility and novelty of said inventions. Analysis of prior art patents related to bioengineering, biomedical technology, and medical devices to advise clients on patent protection and/or product development strategies. Analysis of user requirements, procedures, and problems with inventors' equipment and/or related systems. Discussions with inventors and bioengineering and biomedical industry specialists to determine precise nature of inventions and to advise clients on patent protection strategies. Preparation of charts and diagrams and other documentation that constitutes a representation of the new medical devices in terms that patent examiners and patent attorneys can understand. Communication with U.S. patent examiners and U.S. Patent and Trademark Office regarding examination of patent applications. Manage clients' U.S. and/or international patent portfolios. Provide instructions to patent attorneys in foreign jurisdictions, such as Europe, China, Japan, Korean, Australia, etc. regarding examination of patent applications in foreign jurisdictions. Maintenance of precise records of invention analysis and consultation with inventors in the event of appeal should patent applications be rejected. Participate in business development and client pitches for clients in the bioengineering, biomedical technology, and medical devices industry. The candidate must have a J.D. degree and a Bachelor s degree (or foreign equivalent) in Biomedical Engineering, Bioengineering, or related technical field. Should have 3+ years of experience. Required expertise/knowledge includes: Knowledge of spinal (or intervertebral) implants, Knowledge of rotator cuff repair implants, Knowledge of bone fracture fixation implants, Skilled in using eDrawings and/or Solidworks, Knowledge of FDA regulation of different medical device classes, Knowledge of ISO13495 for medical device development.
