Entry Level Estate Planning and Probate Paralegal Responsibilities: Assist attorneys with drafting estate planning documents, as well as probate and trust administrations. Coordinate the transfer of assets into trusts, including bank accounts, stock transfers and real estate deeds. Assist the Trustee in making distributions. Perform routine trust accounting. Review Wills for creation and direction of testamentary trusts. Correspond and communicate with trusts grantors and beneficiaries. Obtain tax identification number for trust. Draft pleadings appointing or substituting trustees. Prepare schedule of allocations to trusts under will. Estate Administration Prepare and maintain a calendar system, noting important estate administration deadlines and court appearances. Determine whether decedent left a Will and, if it exists, location of Will. Obtain the Will and draft necessary documents to file will with probate court. Review will provisions and report to attorney. Order certified copies of documents, such as the death certificate. Draft documents to commence a probate proceeding; file the same with the probate court. Evaluate assets (as of date of death and alternate valuation date); verify bank balances and prepare inventory. Obtain taxpayer I.D. number for estates from the IRS. Arrange for notice to creditors to be published in a local newspaper. Review creditors claims. Obtain IRS Form 712 from life insurance companies. Obtain and review income tax returns and other financial records. Determine if formal appraisals are necessary and assist the attorney and appraiser. Draft distribution schedule and, as appropriate, coordinate and/or direct the distribution of assets. Maintain estate records. Determine the documentation necessary to effect sale or transfer of probate and non-probate assets including real estate, securities, bank accounts, other case earnings, promissory notes, mortgages, automobiles, and recreational vehicles. Ability to review and interpret Form 706 and Washington Estate Tax Return. Ability to review and interpret Form 709, Federal Gift Tax Return. Work with estate accountant to obtain federal and state tax clearance. Draft all routine documents in a probate proceeding. Draft disclaimers. Draft deeds and real estate excise tax affidavits. Obtain title reports. Obtain County Assessor records as on parcel of real estate. Record deeds with County Recorder. Qualifications: Have a paralegal certificate or associates degree. 5 years' drafting documents experience. Self-motivated Have the ability to think on feet. Have the ability to reason. Proficient in Excel, Word and Outlook. Should be comfortable interacting with clients, as well as have strong oral and written communication skills.
