Workers Compensation Attorney/ Hearing Representative Candidate will work directly with Workers Compensation department, as well as Personal Injury, Employment Law, and other departments within the Firm. Will use professional concepts to resolve moderate to complex claims issues through negotiation or court proceedings. Will need to work independently and use judgment to prepare legal pleadings while coordinating and/or working jointly with supporting staff; and actively meeting with clients; while simultaneously handling 300- 400 files. Oversee and manage approximately 300- 400 litigation matters with the assistance of the assigned Legal Assistant from inception to closure; Supervise assigned support staff; Assist and direct legal assistants with day to day management of each case and pertaining action item(s); Provide availability/ open door policy for legal assistants to present questions on matters for attorney review and final approval. This includes but is not limited to doctor authorizations, settlement documents, panel requests, panel strikes, temporary disability payments, and trial exhibits; Provide plan of action to legal assistant on new cases and cover statute of limitations; Maintain communication with client(s) and staff through the course of the claim. Meeting with clients (in-person, over the phone and/or in court) to initiate contact, answer questions, and discuss case updates, settlement, medical reports, and additional claims; etc.; Answer heavy volume of telephone calls/emails from clients, insurance companies, defense counsel, doctors and medical facilities, and any other parties associated with the case; Assist the injured worker with Workers' Compensation benefits, including obtaining appropriate medical care; Generate position letters, advocacy letter, demands, etc.; Review/ rate medical reports, add med report notes on TriTek, and request supplemental medical reports as needed; Request court hearings to enforce temporary disability, medical treatment disputes, additional panel specialties, and/or any and all issues pertaining to the case; As needed, file petition for penalties against insurance companies/defense attorneys for bad faith conduct, failure to authorize medical treatment, failure to pay within required time frame, etc.; Identify/file Labor Code 132(a) discrimination claims, Serious & Willful Misconduct claims, and/or cross- over cases; Prepare for trail by reviewing the file, drafting open arguments, and prepping clients to give testimony, etc.; Prepare summaries and pre-trial conference statements for hearings; Negotiate settlements on behalf of the claimant; Enter any and all notes relating to each case on TriTrek; Perform legal research; Remain current with developments in the law; Represent the interests of the claimant at hearings, trials, cross- examinations, status conferences, mandatory status conferences, expedited trials, trials, statute appointments; File reviews for all cases, including cross overs; Attend distinct Workers' Compensation boards on behalf of self and colleagues by following their directive; and Other duties as assigned by Management. Requirements: JD degree and current good standing with CA State Bar is required; 2 A A 3 years experience working in a law firm Workers Compensation (Applicant) department; Bilingual, fluent in English/Spanish strongly preferred as over 90% of clients are Spanish speaking. Excellent written and verbal communication skills; and Must have good familiarity with Workers Compensation terminology. Active, acute knowledge of Workers' Compensation laws and procedures;. Active, acute understanding of claims filing process;. Ability to handle large caseloads and juggle multiple priorities and deadlines;. Ability to identify "high value" cases early on and coordinate with staff;. Ability to identify "low value" cases and knowledge of when to drop/refer matter out;. Active knowledge of statute deadlines;. Knowledge of medical issues inherent in Workers Compensation cases;. Knowledge of employment and Personal Injury timelines/deadlines/statutes for cross-over cases;. Strong research, analytical, and negotiation skills. Compassion and understanding of injured worker's plight.
