Settlement Paralegal Candidate will provide a broad range of administrative and operational functions to maintain the Section 32 department. Will include: Complete the C32 process from start to finish, including completing C32 workups. Analyze claims to determine if settlement is the best option for the client's future case handling strategy. Analyze the value of claims taking into account multiple factors. Explain the Section 32 process to clients in terms that are understandable to the client and adjust communication skills accordingly. Answer all routine questions related to settlement, internally within the Firm. Communicate with insurance companies, attorneys and clients in negotiating the best possible settlement for clients. Prepare and send demand letters, acceptance letters, no interest letters, etc. Respond to all C32 inquiries, including emails, phone calls and faxes received in the office, whether client has an interest, or carrier/attorney has interest. Discuss demand, offer and/or counter offer with client. Prepare letters to clients, carriers, doctors, attorneys, MSA vendors, Medicare, SSA and any entity as it relates to the settlement process. Determine on a case by case basis if Medicare approval is needed. Obtain Medical Set-aside and approval from the Centers for Medicare & Medicaid Services, if appropriate. Correspond with MSA vendors and the Centers for Medicare & Medicaid Services regarding medical setasides including sending/obtaining releases, obtaining and reviewing annuity documents, sending letters to clients, carriers, doctors and attorneys and obtaining clarifying medical records upon request. Review settlement agreement drafts, make the required revisions, prepare language specific to each claim and provide to attorney for review. Obtain finalized agreements, all necessary signature and file all documents with the NYS Workers' Compensation Board, carrier(s) and/or attorney(s). File paperwork. Correspond with the Workers' Compensation Board regarding paperwork. Immediately respond to any issues regarding settlement paperwork or hearings. Prepare fee petitions and fee notes for all C32 cases. Prepare necessary legal documents to the Social Security Administration and/or Medicare to include the finat settlement documentation, if necessary. Input settlement information into our file and close file accordingly. Qualifications: Experience in handling New York State Workers' Compensation claims, excellent communication and multitasking skills, attention to detail, a positive attitude, and a strong work ethic. Professional experience in a law firm in the practice area of New York State Workers' Compensation. Proficient in Microsoft Office Suite.
