Tax & Employee Benefits Paralegal Duties: Help to manage and organize the materials and information relating to the tax aspects of matters, transactions, and tax controversy matters. Researching ERISA, IRC, and DOL questions as requested by attorneys. Preparing, and/or reviewing materials for government filings, especially applications for determination letters, voluntary correction applications and Form 5500s. Updating and maintaining an inventory of plan documents, plan amendments and important filings and communications for clients. Drafting retirement plans, welfare plans, amendments and summaries for attorney review. Responding to issues with QDROS. Assist in preparation of tax exemption filings, assist in pre-screening, applications and preparing submissions for tax-exempt status. Legal research and analysis of Tax and ERISA requirements related to retirement plans. Manage response process for DOL/IRS and state regulatory agency requirements and exams. Document production review and indexing. Organization and compilation of client-related documentation. Review and summarize depositions and hearing transcripts. Review, index and summarize FOIA production from IRS. Preparation of various IRS and State Level Forms. Assist with trial exhibits and preparation. Assistant with drafting of correspondence and court filings. Maintain client related electronic files. Case Law research. Scheduling of conferences, client-related meetings and other court appearances. Requirements: Bachelor's Degree or paralegal certificate or designations through an association with certification programs demonstrating knowledge and experience in the area of benefits (i.e. Certified Pension Consultant, Qualified Pension Administrator or Qualified 401(k) Administrator through the American Society of Pension Professionals and Actuaries; Enrolled Retirement Plan Agent, and Accredited Pension Administrator through the National Institute of Pension Administrators). 3+ years of experience as a paralegal or in other legal/tax services roles. Experience with the Internal Revenue Code and ERISA preferred. Experience with health and welfare benefit compliance and familiarity with IRS and DOL rules including ERISA, ACA, COBRA and HIPAA preferred. Working knowledge of the general retirement plan qualification rules under IRC Section 401 and ERISA preferred. Strong oral and written communication skills. Proficient using Excel, Word and other database and document assembly software. Must be detail-oriented, efficient and able to coordinate multifaced projects with a minimum of supervision. Proficiency in Lexis or Westlaw and web-based research strongly preferred. Ability to problem-solve, set priorities and to ask questions when needed. Ability to meet tight deadlines. Demonstrates persistence to overcome obstacles. Availability to work overtime as needed.
